1.Prohibited Materials
The following materials may not be included in any job posted to or performed through the Junk Out LLC Platform:
- Asbestos-containing materials (any friable ACM)
- Lead-based paint waste and lead-contaminated debris
- Mercury-containing devices (thermometers, thermostats, fluorescent tubes with damaged sleeves)
- Wet paint, solvents, thinners, and unmarked chemical containers
- Automotive/marine fluids: motor oil, transmission fluid, brake fluid, gasoline, diesel
- Batteries (auto, marine, industrial); household batteries only in factory packaging
- Pressurized cylinders: propane tanks, oxygen tanks, refrigerants, aerosol cans that are not fully empty
- Tires with mounted rims containing water or road fluid
- Radioactive materials and smoke detectors containing Am-241
- Biomedical waste, sharps, human or animal remains, blood-borne pathogen materials
- Firearms, ammunition, explosives, fireworks
- Any material regulated as hazardous by 40 CFR Parts 260–273 or by Florida Department of Environmental Protection
2.Customer Representations
By posting a job you affirm, under penalty of perjury, that to the best of your knowledge the items to be hauled contain none of the prohibited materials listed above. You further represent that you are the lawful owner or authorized agent of the items being removed.
3.On-Site Refusal
If a Crew identifies prohibited materials on-site, the Crew has the right to refuse those items or the entire job. Any escrow may be forfeited to the Crew to compensate for time and travel. Repeat violations may result in Customer account suspension.
4.Indemnification for Hazardous Materials
You agree to indemnify and hold harmless Junk Out LLC and its Crews from all claims, fines, penalties, remediation costs, and legal fees arising from the presence of hazardous or prohibited materials in your job, whether disclosed or undisclosed at the time of booking.
5.Reporting Environmental Concerns
If you discover after booking that your job may contain any prohibited material, contact support@junkoutllc.com immediately. We can refer you to licensed hazmat haulers in your area.
6.Governing Law
This Waiver is governed by the laws of the State of Florida and applicable federal environmental law.
