1.Acceptance of Terms
By creating an account, posting a job, or accepting an offer through the Platform, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Platform.
2.The Platform
Junk Out LLC operates a two-sided technology platform that connects customers seeking hauling, cleanout, moving, demolition, and related services (“Customers”) with independent hauling contractors (“Crews”). Unless otherwise stated at the time of booking, Junk Out LLC is not itself the crew performing the physical service; the Crew you select is an independent contractor and not an employee or agent of Junk Out LLC. In the specific geographic areas Junk Out LLC services directly, Junk Out LLC and its own employees may appear on the Platform as a Crew and perform the physical work — in which case the applicable Crew terms of this Agreement apply to Junk Out LLC as well.
3.Eligibility
You must be at least 18 years old and legally able to enter contracts to use the Platform. Crews must maintain any licensing, insurance, and permits required by their jurisdiction.
4.Accounts and Security
You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at support@junkoutllc.com of unauthorized access.
5.Jobs, Quotes, and Escrow
Customers post jobs describing the service needed. Crews review offers and submit quotes. When a Customer selects a Crew's quote, the Customer authorizes the quoted amount to be held in a platform-managed escrow.
Funds are released to the Crew (net of the applicable platform fee) after the Customer confirms the work is complete and satisfactory. See the Contractor Agreement for the fee schedule.
6.Fees
Junk Out LLC charges Crews a monthly subscription fee ($4.99 Basic · Pro Subscriber, or $2.00 Standard) plus a per-job platform fee ranging from 4.00% (Basic flat, or Standard “Recycling & Donation”) to 8.00% (Standard “Demolition & Debris”). Customers pay only the Crew’s quoted amount plus any applicable taxes. There is no platform fee charged directly to the Customer.
7.Prohibited Items and Hazardous Waste
Customers may not request hauling of hazardous, toxic, radioactive, biomedical, or otherwise regulated materials, including but not limited to: asbestos, lead paint, mercury, wet paint, batteries, tires containing fluid, propane tanks, refrigerants, unmarked chemical containers, or biological waste. Violations may result in job cancellation, forfeiture of escrow funds, account suspension, and referral to authorities. See the Hazardous Materials Waiver for details.
8.Cancellation and Refunds
Customers may cancel a job before a Crew has been dispatched at no cost. After dispatch and prior to completion, cancellations may forfeit a portion of the escrowed amount to compensate the Crew for time and travel. Refunds for disputed completed work are handled per the Dispute Resolution section.
9.Dispute Resolution and Arbitration
Any dispute arising out of these Terms shall first be attempted to be resolved informally by contacting support@junkoutllc.com. If unresolved within 30 days, the dispute shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in State of Florida (Seminole County, FL). Both parties waive the right to a jury trial and to participate in class actions.
10.Limitation of Liability
To the maximum extent permitted by law, Junk Out LLC’s aggregate liability arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total platform fees paid to Junk Out LLC by you in the six (6) months preceding the claim, or (b) US$100. Junk Out LLC is not liable for indirect, incidental, consequential, or punitive damages, including property damage caused by a Crew during a job.
11.Indemnification
You agree to indemnify and hold harmless Junk Out LLC, its officers, and members from any claim arising out of your use of the Platform, including violations of these Terms, misrepresentation of job contents, or the unauthorized inclusion of hazardous materials in a haul.
12.Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
13.Changes
Junk Out LLC may update these Terms from time to time. Material changes will be announced by email and by a notice on the Platform at least 14 days before taking effect.
